1. Các loại tranh chấp hợp đồng bảo hiểm

2. Xác định thẩm quyền giải quyết tranh chấp hợp đồng bảo hiểm

-  Tòa án nhân dân cấp huyện giải quyết tranh chấp hợp đồng bảo hiểm nhân thọ; các hợp đồng bảo hiểm phi nhân thọ ký giữa tổ chức bảo hiểm với cá nhân, tổ chức không nhằm mục đích sinh lợi quy định tại khoản 3 Điều 25 Bộ luật tố tụng dân sự.

VD: Bảo hiểm sức khỏe và bảo hiểm tai nạn con người; cá nhân mua bảo hiểm xe cơ giới;…

-  Tòa án nhân dân cấp tỉnh giải quyết tranh chấp hợp đồng bảo hiểm phi nhân thọ ký giữa tổ chức bảo hiểm với cá nhân, tổ chức có đăng ký kinh doanh và nhằm mục đích lợi nhuận.

3. Thời hiệu khởi kiện

-  Thời hiệu khởi kiện về hợp đồng bảo hiểm là 3 năm, kể từ thời điểm phát sinh tranh chấp (Điều 30 Luật kinh doanh bảo hiểm).

-  Thời hiệu khởi kiện liên quan đến hợp đồng bảo hiểm hàng hải là 2 năm, kể từ ngày phát sinh tranh chấp (Điều 257 Bộ luật Hàng hải Việt Nam).

4. Xác định sự kiện bảo hiểm

Ở các tình huống bảo hiểm đều có độ phức tạp và khó trong xác định lỗi của các bên và của bên thứ ba. Đây cũng là nội dung khó nhất trong vụ việc tranh chấp hợp đồng bảo hiểm nói chung và là cơ sở để xác định có hay không trách nhiệm bảo hiểm của công ty bảo hiểm.

5. Trường hợp hợp đồng bảo hiểm vô hiệu

+ Bên mua bảo hiểm không có quyền lợi có thể bảo hiểm;

+ Tại thời điểm giao kết hợp đồng bảo hiểm, đối tượng bảo hiểm không tồn tại;

+ Tại thời điểm giao kết hợp đồng bảo hiểm, bên mua bảo hiểm biết sự kiện bảo hiểm đã xảy ra;

+ Bên mua bảo hiểm hoặc doanh nghiệp bảo hiểm có hành vi lừa dối khi giao kết hợp đồng bảo hiểm.

Ngoài ra, tổ chức, cá nhân có nhu cầu bảo hiểm chỉ được tham gia bảo hiểm tại doanh nghiệp bảo hiểm hoạt động ở Việt Nam. Trong trường hợp có tranh chấp hợp đồng bảo hiểm phát sinh từ việc giao kết hợp đồng bảo hiểm được giao kết giữa các tổ chức, cá nhân Việt Nam với doanh nghiệp bảo hiểm không được phép hoạt động tại Việt Nam thì bị coi là vô hiệu.
